A legal petition filed by 5 voters in Illinois is challenging ex-president Donald Trump being on the March 6 Illinois primary ballot.

The claim is the former president encouraged & did little, if any to discourage or try to stop the riot that happened on January 6, 2021 after then president Trump had lost the 2020 presidential election to Joe Biden.

The petition which is similar to other petitions from around the USA, seeks to use the 14th Amendment of the US Constitution to bar Trump from seeking office, based on his role in the January 6 attack on Washington, D.C. by his supporters.

The 87-page document, signed by five people who are not named publicly, from around the state, attempts to lay out a case that Trump, having lost the 2020 election to Democrat Joe Biden, fanned the flames of hardcore supporters who attacked the Capitol on the day Congress certified the election results.

The riot on Jan. 6, 2021, left five dead, including a police officer and more than 200 injured, including police officers, and has seen hundreds sentenced to prison for their roles in the riot that day, with some sentences being as long as 18 years for convicted ring leaders.

The Illinois State Board of Elections had yet to set the petition for hearing Thursday afternoon, spokesperson Matt Dietrich said. The board is set to hear 32 other objections to the proposed ballot at its Jan. 11 meeting.
